Article 1 These Regulations are formulated in accordance with the Decision of the CPC Central Committee on Deepening the Reform of Party and State Institutions and the Plan for Deepening the Reform of Party and State Institutions approved by the Third Plenary Session of the 19th CPC Central Committee and the Plan for the Reform of the State Council Institutions approved by the First Session of the 13th National People's Congress. Article 2 The Ministry of Human Resources and Social Security is a component department of the State Council and is at the ministerial level. Article 3 The Ministry of Human Resources and Social Security implements the principles, policies, decisions and arrangements of the CPC Central Committee on human resources and social security work, and adheres to and strengthens the centralized and unified leadership of the Party over human resources and social security work in the process of performing its duties. The main responsibilities are: Formulate policies and plans for the development of human resources and social security, draft relevant laws and regulations, formulate departmental regulations and organize their implementation. Formulate plans for the development of the human resources market and the development of the human resources service industry and policies for the flow of human resources, and promote the rational flow and effective allocation of human resources. Responsible for promoting employment, formulating employment development plans and policies that coordinate urban and rural areas, improving the public employment and entrepreneurship service system, coordinating the establishment of a vocational skills training system for urban and rural workers, formulating an employment assistance system, and taking the lead in formulating employment policies for college graduates. Coordinate and promote the establishment of a multi-level social security system covering urban and rural areas. Formulate policies and standards for social insurance such as pension, unemployment, and work-related injuries and their supplementary insurance. Formulate national coordination methods for pension insurance and national unified transfer methods for pension, unemployment, and work-related injury insurance relations. Organize the formulation of management and supervision systems for social insurance such as pension, unemployment, and work-related injuries and their supplementary insurance funds, prepare draft budgets and final accounts for relevant social insurance funds, and participate in the formulation of relevant social security fund investment policies. Implement the universal insurance plan in conjunction with relevant departments and establish a national unified social insurance public service platform. Responsible for forecasting, early warning, and information guidance for employment, unemployment, and related social insurance funds, formulate response plans, implement prevention, regulation, and control, maintain a stable employment situation and a balance of overall income and expenditure of related social insurance funds. Coordinate the formulation of labor and personnel dispute mediation and arbitration systems and labor relations policies, improve labor relations consultation and coordination mechanisms, formulate employee working hours, rest and vacation systems, and formulate policies to eliminate the illegal use of child labor and special labor protection policies for female and underage workers. Organize and implement labor and social security supervision, coordinate workers' rights protection work, and investigate and deal with major cases in accordance with the law. Take the lead in promoting the deepening of the professional title system reform, formulate policies such as professional and technical personnel management, continuing education and postdoctoral management, be responsible for the selection and training of high-level professional and technical personnel, and formulate policies to attract overseas students to work or settle in China (return to China). Organize the formulation of a system for the training, evaluation, use and incentives of skilled personnel. Improve the professional qualification system and improve the diversified evaluation policy of professional skills. Guide the reform of the personnel system of public institutions in conjunction with relevant departments, be responsible for standardizing the comprehensive personnel management work such as post setting, public recruitment, and employment contracts of public institutions in accordance with management authority, and formulate management policies for public institution staff and agency workers. Formulate a national commendation and reward system in conjunction with relevant departments, comprehensively manage national commendation and reward work, undertake national evaluation and standard-reaching commendation and provincial and ministerial commendation, and host national commendation and reward activities in the name of the Party Central Committee and the State Council according to authorization. Formulate a wage income distribution policy for public institution employees in conjunction with relevant departments, and establish a mechanism for the determination, normal growth and payment guarantee of wages for employees of enterprises and institutions. Formulate welfare and retirement policies for employees of enterprises and institutions. Formulate comprehensive policies and plans for migrant workers in conjunction with relevant departments, promote the implementation of relevant policies, coordinate solutions to key and difficult issues, and safeguard the legitimate rights and interests of migrant workers. Be responsible for international exchanges and cooperation in the field of human resources and social security, and formulate a management system for staff sent to international organizations. Complete other tasks assigned by the Party Central Committee and the State Council. Functional transformation. Deepen the reform of streamlining administration, delegating power, combining regulation and supervision, and optimizing services, further reduce administrative approval matters, standardize and optimize external affairs, reduce approval matters such as professional qualification licenses and certifications, implement national professional qualification catalog list management, strengthen in-process and post-process supervision, innovate public service methods such as employment and social security, strengthen information sharing, and improve the level of public services. The employment policy for college graduates is led by the Ministry of Human Resources and Social Security and formulated in conjunction with the Ministry of Education and other departments. The Ministry of Education is responsible for employment guidance and services for college graduates before they leave school; the Ministry of Human Resources and Social Security is responsible for employment guidance and services for college graduates after they leave school. Article 4 The Ministry of Human Resources and Social Security shall have the following internal institutions: General Office. Responsible for the daily operation of the agency, and undertakes information, security, confidential, confidential, petition, government affairs disclosure and other work. Policy Research Department. Organize and carry out research on human resources and social security policies and reform promotion work, undertake the drafting of important manuscripts, coordinate expert consultation, press release and other work. Law and Regulations Department. Organize the drafting of relevant draft laws and regulations, undertake the legality review of normative documents, and undertake administrative reconsideration, administrative litigation and other work. Planning and Finance Department. Formulate development plans and annual plans for human resources and social security, prepare draft budgets and final accounts of relevant social insurance funds, and participate in the formulation of relevant social security funds (funds) financial management systems. Undertake statistics, information planning, state-owned assets management, internal auditing, and relevant international aid and loan projects. Employment Promotion Department. Formulate employment plans, plans and policies on fair employment for workers, transfer of rural labor, orderly cross-regional migration, and improve the public employment and entrepreneurship service system. Take the lead in formulating employment policies for college graduates, formulate policies such as employment assistance and employment for special groups, and participate in formulating management measures for employment subsidy funds. Department of Human Resources Mobility Management. Formulate policies and plans for the development of the human resources market, human resources service industry and human resources mobility, guide the management of human resources social service agencies, formulate personnel (excluding civil servants) deployment policies and organize their implementation. Department of Vocational Capacity Building. Organize the formulation of systems for the training, evaluation, use and incentives of skilled personnel, formulate policies and plans for vocational training of urban and rural workers, guide the development of technical school education and vocational skills training, guide the construction of teaching staff and teaching materials, and formulate occupational classification and vocational skills standards. Department of Professional and Technical Personnel Management. Organize and promote the deepening of the professional title system reform, formulate policies for the management and continuing education of professional and technical personnel, improve the professional qualification and postdoctoral management system, undertake the planning, training and selection of high-level professional and technical personnel and organize the selection of personnel who enjoy special government subsidies. Formulate management policies to attract overseas students to work and settle in China (return to China) and for foreign institutions to recruit professional and technical backbone talents in China. Department of Personnel Management of Public Institutions. Guide the reform of the personnel system of public institutions, formulate management policies for public institution staff and office workers, undertake the filing of public institution post settings in accordance with management authority, and formulate policies for public institutions to recruit foreign personnel (excluding experts). Department of Migrant Workers. Formulate comprehensive policies and plans for migrant workers, promote the implementation of relevant policies, safeguard the legitimate rights and interests of migrant workers, and coordinate the handling of key and difficult issues and major events involving migrant workers. Department of Labor Relations. Formulate labor relations policies and labor contracts and collective contract systems, formulate employee working hours, rest and vacation systems, formulate policies to eliminate the illegal use of child labor and special labor protection policies for female workers and minors. Formulate macro-control and payment guarantee policies for the wage income distribution of enterprise employees, guide and supervise the total wage management of state-owned enterprises and the wage income distribution of enterprise leaders. Department of Wages and Welfare. Formulate wage income distribution, welfare and retirement policies for public institution staff and office workers, organize the formulation of wage policies for non-diplomatic personnel stationed abroad, and undertake the total performance wage management of central public institutions. Pension Insurance Department. Formulate policies and standards for basic pension insurance, enterprise (occupational) annuities, and personal savings pension insurance for government agencies, enterprises, and institutions; formulate national pension insurance pooling and fund management methods; improve fund forecasting and early warning systems; and review provincial basic pension insurance premium rates. Unemployment Insurance Department. Formulate unemployment insurance policies, standards, and fund management methods; establish unemployment monitoring and early warning systems; formulate policies to prevent, regulate, and control large-scale and economic restructuring involving the protection of employee resettlement rights and interests. Work Injury Insurance Department. Formulate work injury insurance policies, plans, and standards and organize their implementation; improve work injury prevention, identification, and rehabilitation policies; and organize the formulation of standards for the identification of disability levels caused by work injuries and occupational diseases. Rural Social Insurance Department. Formulate policies, plans, and standards for basic pension insurance for urban and rural residents and social security for expropriated farmers; formulate and organize the implementation of review methods for social security measures for expropriated farmers in land expropriation plans. Social Insurance Fund Supervision Bureau. Formulate supervision systems and pension fund operation policies for social insurances such as basic pension, unemployment, and work-related injuries, as well as enterprise (occupational) annuities and personal savings pension insurance funds, supervise the income, expenditure, management and investment operations of the funds in accordance with the law, organize the investigation and handling of major cases, and participate in the formulation of relevant social security fund investment policies. Mediation and Arbitration Management Department. Formulate labor and personnel dispute mediation and arbitration systems and guide their implementation, guide the prevention of labor and personnel disputes, and guide the handling of major labor and personnel disputes in accordance with the law. Labor and Social Security Supervision Bureau. Formulate labor and social security supervision work systems, investigate and supervise major cases in accordance with the law, guide local labor and social security supervision work, coordinate workers' rights protection work, and organize the handling of relevant emergencies. National Recognition and Reward Office. Formulate national recognition and reward systems, undertake recognition and reward activities carried out in the name of the Party Central Committee and the State Council according to authorization, undertake the management of relevant national recognition and reward recipients, State Council honorary title recipients, and provincial and ministerial honorary title recipients, and undertake national evaluation and recognition and provincial and ministerial recognition related work. International Cooperation Department (Hong Kong, Macao and Taiwan Office). Undertake international exchanges and cooperation, exchanges and cooperation with Hong Kong, Macao and Taiwan, and foreign affairs management, and formulate management systems for staff sent to international organizations. Personnel Department. Undertake personnel management, organization establishment and team building of the agency and its subordinate units, and undertake administrative appointment and removal procedures for some leading personnel under the central management. Party Committee of the Agency. Responsible for the party and mass work of the agency and its subordinate units in Beijing. Bureau of Retired and Resigned Cadres. Responsible for the work of retired and resigned cadres of the agency, and guide the work of retired and resigned cadres of its subordinate units.
